1) Acceptance of these Terms

2) Definitions
- “GrowingAI”, “we”, “us”, “our” refers to GrowingAI and its operators.
- “You”, “your”, “Client” refers to the person or entity using the Site or purchasing services.
- “Services” means SEO, AI SEO, content systems, conversion UX, automation, tracking, WebMCP planning, and related deliverables.
- “Deliverables” are agreed outputs (documents, audits, page structures, implementation checklists, designs, code snippets, etc.).
3) Services & Scope
The scope, pricing, timelines, and deliverables are defined in a written proposal, statement of work, invoice, or email confirmation (the “Agreement”). If there is a conflict between these Terms and the Agreement, the Agreement controls for that project.
We may update or improve how we deliver services over time, as long as the overall scope remains aligned with the Agreement.
4) Accounts, Inputs & Communications
To deliver services, you may need to provide inputs (brand details, access to tools like Analytics/Search Console, CMS access, assets, etc.). You confirm you have the right to share those inputs with us.
- You are responsible for the accuracy and legality of information you provide.
- Delays in inputs or approvals may delay timelines.
- We may communicate via email, WhatsApp, or other agreed channels for project updates and approvals.
5) Payments, Invoices & Refunds
Payment terms are defined in the Agreement. Unless otherwise stated, invoices are due upon receipt and work may begin only after payment confirmation.
- Milestones: For milestone projects, delivery is staged and tied to milestones.
- Subscriptions/Retainers: If you are on a monthly plan, payments are due at the start of each period unless stated otherwise.
- Refunds: Because services involve time-based work, refunds are generally not provided once work has started. If you believe a billing error occurred, contact us within 7 days of the invoice date.
- Chargebacks: If a chargeback is initiated, we may pause services until resolved.
6) Acceptable Use of the Site
You agree not to use the Site to:
- Break any law or regulation.
- Upload or transmit malicious code, spam, or harmful content.
- Attempt unauthorized access to our systems or third-party systems.
- Copy, scrape, or misuse Site content beyond normal browsing (except as permitted by law).
- Use the Site in a way that harms performance or availability.
7) Intellectual Property
The Site content, branding, and design are owned by GrowingAI or licensed to us. You may not reproduce or distribute it without permission.
For project deliverables: ownership and licensing are defined in the Agreement. Unless stated otherwise:
- You own final deliverables after full payment is received.
- We may reuse general know-how, frameworks, and non-confidential methods across projects.
- You grant us the right to display non-confidential work samples (unless the Agreement says otherwise).
8) Third-Party Tools & Links
We may recommend or integrate third-party tools (analytics platforms, CRMs, automation tools, hosting providers, etc.). We are not responsible for third-party services, their outages, pricing changes, or data handling. Review their terms and policies.
9) Disclaimers
The Site and services are provided “as is” and “as available.” Marketing outcomes can be affected by factors outside our control (competition, algorithm changes, ad policy changes, your sales process, market demand, seasonality, technical constraints, and more).
- No guarantees: We do not guarantee rankings, traffic levels, leads, or revenue.
- AI outputs: Where AI is used for research/structure, final outputs may still require human review and your approvals.
10) Limitation of Liability
To the maximum extent permitted by law, GrowingAI will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill.
Our total liability for any claim related to services will not exceed the amount you paid to us for the specific service giving rise to the claim in the 3 months before the event (unless the Agreement specifies a different cap).
11) Indemnity
You agree to indemnify and hold GrowingAI harmless from claims, damages, liabilities, and expenses arising from: (a) your misuse of the Site, (b) content/assets you provide, (c) violation of law, or (d) your breach of these Terms.
12) Termination
We may suspend or terminate access to the Site if misuse is detected. Project termination terms (notice, partial delivery, payment obligations) are defined in the Agreement. If not specified, either party may terminate by written notice, and you will pay for completed work up to the termination date.
13) Governing Law & Dispute Resolution
These Terms are governed by the laws of India, without regard to conflict of law principles. If a dispute arises, both parties agree to attempt a good-faith resolution first. If unresolved, the courts with appropriate jurisdiction in India will apply.
14) Changes to these Terms
We may update these Terms from time to time. The “Last updated” date will change accordingly. Continued use of the Site after updates means you accept the updated Terms.
